Apple sold a defective iPhone X to a customer four times, and his reaction was unexpected.

Hello.

At the end of November, my wife gave me an iPhone 7, purchased from the C Store (Perm)

Everything was fine with the phone, I didn’t notice any complaints about the work (and I didn’t look for it - the phone was new, after all). A couple of times I caught the hair on my temples with something, but didn’t pay attention special attention, thoughts about beardgate or something similar popped into my head.

About a month later, under New Year, I was still puzzled by this problem and discovered that there was a gap between the screen and the body at the top. A piece of paper can easily fit in there. I didn't notice any gaps on the other edges.

I contacted Apple technical support, who told me that this was definitely a defect, and it shouldn’t be like that, and advised me to contact an authorized service center. Fortunately, there is such a center in Perm, I brought the phone there. They examined the phone and said that they couldn’t help me because the phone had been opened and there were scratches on the screws.

Here I got a little depressed. I myself, of course, had no need to open it; from the moment of purchase, no one else could do this either. It turns out that they sold my wife a phone that the would-be repairmen had already talked to (after looking more closely, I noticed that the screen was installed crookedly - the lower part protrudes above the body, a “step” is felt with your finger).

And then I became even more depressed - the two weeks before I could just hand over the phone had passed a long time ago, and if I came to the seller now, he would tell me that I opened it myself, because when I bought it, they examined it and found nothing.

Unfortunately, this is very difficult to notice upon a quick inspection, especially when you buy a phone from a premium Apple reseller, and especially if you are a girl who is not too keen on technology.

Now other problems have appeared - for example, the phone does not immediately wake up from standby mode ( dark screen), not responding to buttons (this also happens when incoming call), but I attribute this problem to the software. And sometimes the screen does not respond to touches, but here I can’t say 100% - this happens in one toy, maybe I’m just not used to the size of the screen and while I’m trying to do an action with my left hand, my right touches the screen, resulting in a false positive.

I don’t know what to do now. I’ll come to Svyaznoy and they’ll say that they sorted it out themselves. If I don’t come, I’ll have a leaky phone, and the sellers will get away with everything.

Any ideas?

At the beginning of this month, the frameless iPhone X appeared on store shelves in many countries around the world, which is sold at the official recommended price of 79,990 rubles (in Russia). Its basic modification, which is equipped with 64 GB of permanent flash memory, will cost this amount, while the model with a 256 GB drive costs significantly more - 91,990 rubles. It's obvious that times Apple sells his new flagship at the highest price worldwide of any mobile device on the market, then it must be the best in everything. Alas, this does not happen, since the number of defects in the new product is simply off the charts.

A user from the Reddit forum told his short story about how Apple sold him a defective iPhone X four times. It all started with the fact that on the day of the start of sales he came to Apple store Store, having stood there for an hour in line. When he came home with the purchase, he discovered that under the expensive OLED screen mobile device there is dust. He went to the store Apple Store, where he was immediately exchanged for a new phone. The second phone also failed because it had dead pixel. The smartphone was exchanged for him again.

The third time iPhone buyer X from the USA was even more unlucky as he not only had two dead pixels, but also dust under the camera. At that moment, he thought that someone had jinxed him, but still decided to come to the Apple Store again, where he was given his fourth smartphone. When he came home again and carefully examined his $1,149 purchase (excluding tax), he discovered one dead pixel and small scratches at the top of the screen.

His reaction, according to the buyer himself, was unexpected. Being a loyal fan Apple, he immediately wanted to go to the Apple Store and demand his money back to the last center, and then go to the nearby Samsung store and buy there Galaxy Note 8 or Galaxy S8, where there are no such problems (in his opinion). Now the angry buyer is at the stage of going to the Apple store to return the money for the fourth phone and buy himself another mobile device. He believes that fate does not allow him to buy an iPhone X, since getting his hands on a defective phone four times is definitely a mismatch and not a coincidence. How this story will end is still unknown.

In August 2014, a resident of Penza purchased a iPhone store 6 costing RUB 52,990. Soon a problem occurred: while trying to make a call, the Penza resident discovered that the device had turned off spontaneously, although it was more than half charged, and no longer showed signs of life. This happened during the warranty period.

As reported, the owner of the smartphone contacted the seller with a complaint, in which he asked to return the money for the product. He also paid for an examination, which revealed that the phone had a manufacturing defect.

Without waiting for a response to the application, the man filed a statement of claim in which he asked to recover in his favor the cost of the iPhone, a penalty for violating the deadlines for satisfying claims, losses incurred, compensation for moral damages and a fine of 50% of the amount awarded in favor of the consumer.

A representative of the company did not agree with the claim and stated that the defect could have been eliminated, but the buyer did not request to replace or repair the device.

A forensic commodity examination confirmed the production nature of the malfunction: the central processor had failed.

According to the Law of the Russian Federation “On the Protection of Consumer Rights,” the buyer, having discovered a defect in a technically complex product, has the right to refuse to fulfill the sales contract and demand a refund or replacement of the product with a recalculation of the price within 15 days after purchase. When this period expires, the requirements are satisfied if a significant defect is found in the product.

The court of first instance recovered 196,565 rubles from Svyaznoy Logistics JSC in favor of the buyer. Disagreeing with the decision, the defendant's representative filed an appeal.

“The judicial panel for civil cases changed the decision, reducing the amount of the penalty and fine. Thus, the defendant must pay 185,437 rubles. The decision has entered into legal force,” reports the press service of the Penza Regional Court.

This is not the first time a defective iPhone has been returned to the seller through court. In January 2014, a resident of Krasnoyarsk was accused of a defective iPhone 4s model. In March of the same year, the court ordered Euroset to pay 95,000 rubles to a Volgograd resident who bought a non-working iPhone 4s. In November, a trial against unscrupulous iPhone seller in favor of the buyer. At the end of 2015, a resident of Yekaterinburg paid for an iPhone 6, which three months later began to freeze and turn off.

In all cases, the court decided to terminate the purchase and sale agreement and recover from the retailers in favor of the plaintiffs the amount spent on the purchase of phones, as well as a penalty, compensation for moral damage, a fine, expenses for conducting an examination and legal fees.

Buying Apple smartphones, most users, taking into account the worldwide reputation of the brand, hope to receive a high-quality gadget without any deviations (“glitches”, “bugs”) and certainly do not expect to find a defect in an expensive device. In addition, people want to see noticeable improvements in the new model compared to the previous version. But still, the iPhone cannot satisfy all the needs of demanding users who find flaws in the smartphone. The new product was no exception.

Processor noise: normal or defective?

Experts note that in new version iPhone installed the most powerful mobile processor of those currently existing. But in practice it turned out to be not so ideal. Holders latest model iPhone noticed a strange noise that it makes during operation. According to experts, previous versions They also made similar sounds when the smartphone was under load, that is, when watching videos online, launching games and other programs and applications. Perhaps users have become more attentive to such things after recent incidents with gadgets Samsung Galaxy Note 7 whose batteries caught fire when overheating. Cases like this motivate people to be more wary of the strange sounds that the iPhone 7 makes.

Since the model is new, it has not yet been possible to find out whether such hissing and noise in any way affects the performance and quality of the phone. By the way, in iPhone models 7 and iPhone 7 Plus are equipped with the A10 Fusion processor, which does an excellent job of launching and running any application.

Frightened by the hissing of the gadget, users immediately began discussing the problem on various forums and even came up with a separate name for it - “HissGate”.

Communication problems or speaker defects?

It seems like during iPhone creation 7, the developers were so busy coming up with new functions and improving the characteristics of the smartphone that they forgot about its main purpose - making phone calls.

Owners of the latest iPhone model around the world are complaining about bad sound During a conversation, it is very difficult to hear the interlocutor. Such a defect can be caused, for example, by an incorrectly cut SIM card to fit the format Nano Sim, which is required this model phone. But the number of complaints suggests that the iPhone 7 is still defective.

Some experts believe that this drawback appeared due to a special membrane that is designed to guarantee. That is, while trying to improve the additional qualities of the smartphone, the developers did not take into account the deterioration of the main function of the gadget.

Attention to details

In addition to the above, the most demanding and attentive users also note that there are a lot of visible fingerprints left on the body and display of the latest iPhone model, which spoils the perfect appearance phone and forces you to buy a case for the device. Also, some smartphone owners observe a slight slowdown in operation when fast switching between programs.

Apple developers decided to remove the standard connector, called a mini-jack, but not everyone happily accepted this innovation. Now iPhone owners 7 can only be used by headphones that support the Lightning digital connector. Or standard ones, but with the help of a special adapter. An option is also available.

Do manufacturers respond to customer dissatisfaction?

Because the sound is bad conversational dynamics iPhone 7 did not cause any scandals published in the press or online; Apple representatives did not give any official comments. At the same time, if the user notices a similar defect in his iPhone, service center They will not refuse to return or exchange your smartphone for a new one. True, given the worldwide demand for new model, the frustrated owner of a defective smartphone may have to wait new iPhone for an indefinite period. Many iPhone 7 owners have already contacted the AppleCare department, which exchanged defective gadgets for new ones for free.

The choice is yours

It's up to you to count the processor hiss and it's not enough good sound The earpiece speaker in the iPhone 7 is defective. Since each user has his own individual needs and expectations from purchasing a gadget. If the quality characteristics of a smartphone, its performance and performance are in the first place for you when choosing, and your iPhone 7 is defective, contact technical support and get new phone. If the above disadvantages, in your opinion, are insignificant compared to all the advantages of the iPhone and do not cause any discomfort when using the device - enjoy new purchase and make the most of all its advantages.

Hello everyone!

I decided to write this review to help you if You are faced with the arrogance and rudeness of the managers of this store and are trying to return a defective product .

This review will be long, so I structured it as follows:

  1. First, I will describe a situation that, unfortunately, happens often in our time. Interaction between seller - buyer - store manager
  2. Then I'll tell my story
  3. Next, I will give guidance on what to do if you find yourself in a similar situation.
  4. I will support my review (and your further complaint to the retail outlet/store) with quotes from articles of the Federal Law from the latest edition (as amended on May 5, 2014), which you need to rely on when returning goods to the store. This law is easily accessible on the Internet!

So, everyone knows that returning equipment to the store is difficult, and the more expensive it is, the more difficult it is! They will offer you an examination, tell you that your phone will be taken away, all this may take 30-45 days, etc. They will refer to the law of supposedly their store! And you refer to the PDA! (Consumer Protection Law) Remember that you have the right to:

  1. Demand the full amount back or replace the product with a new identical one if there is no visible damage to the device (within 15 days from the date of purchase) - if a hidden defect is discovered!
  2. Submit a WRITTEN claim to the store, and you MUST accept it and record it in writing on a duplicate of the claim (which remains with you) and put the store’s seal and the signature of the responsible employee on it (this can simply be the seller’s signature)
  3. Do not give your phone to the store and demand (in writing) that if an examination is necessary, you are notified in writing of its conduct (no later than 10 days from the date of filing the claim) and that you drive there YOURSELF and bring the device (which will be with you ) and were present during the examination!

My history:

Not long ago, namely on October 1, 2014, I purchased an Apple iPhone 6 Plus from the Svyaznoy store by placing an order online. Why in Svyaznoy? Yes, because in Nizhny Novgorod, due to the incredible hype for them, they were simply out of stock almost everywhere (I needed a model with a certain amount of memory and a certain color), and it was only possible to place an order via the Internet and receive it at the goods distribution center - the store (for Nizhny Novgorod residents: Osharskaya st., 21) That’s what I did! I was crazy about the purchase, I was a little sad for my old man... And 5 days after the purchase I discovered a bright light spot on the left top corner screen and a small oblong spot in the middle of the screen at the top. It looked as if they turned up the screen backlight at full power, then turned down the brightness, and it decreased everywhere except in the area of these spots. (Unfortunately, I didn’t take a photo of this beauty)) Rebooting, and later resetting the settings (already in the store) did not help! I was extremely determined. Such a rude defect in a phone for 42 thousand on the 5th day of purchase!!! Unthinkable!) And the next day I took the phone to the store where I picked it up... It took me 40 minutes, 2 complaints written in advance and the text of the PDA law, to return the phone (in my case, they couldn’t exchange it for me, since this is a pre-order store) and issue a refund. The money went to my card (2 days have passed so far, but it takes up to 30 days - it hasn’t arrived yet), so it’s BETTER TO PAY IN CASH! So that your money can be returned to you immediately! I would like to NOTE THAT THE SELLERS - CONSULTANTS WE FOUND ARE POLITE AND COURTESE, AND THE MANAGER WITH WHOM I TALKED ON THE PHONE 3 TIMES (he was not in the store) kept trying to submit my phone for examination, and he tried to mislead me, saying that This is what the PDA prescribes, but since this law was in printed form before my eyes, he failed to do this.!)

RESULTS:

  1. I handed over the phone
  2. I bought a new one just like it
  3. I'm waiting for money (it takes up to 30 days for the card to arrive) - this is an inconvenience!

What you need to do if you want to return a product in which you discovered a hidden factory defect within 15 days after purchase:

  1. Collect full set: box + all sorts of things chargers - headphones.. All that has gone before. + checks! + card (if you paid by bank card- what, after my experience, I don’t recommend doing when making a large purchase)
  2. Write a claim (Google it, but in principle - in free form) in 2 copies, clearly and accurately stating your requirements. Attach a photocopy of receipts to each claim.
  3. Print out the PDA and have it with you! It is important! They will argue with you!
  4. You must return the money or exchange the goods!
  5. If none of the above helps, get your claim accepted and recorded in writing on your copy, wait 10 days and go to Rospotrebnadzor, the Antimonopoly Committee. - notify the sellers and manager about this, they may change their decision)
  6. If we're talking about O Apple technology, ask the manager for the number of the dealer agreement with Apple Corporation, on the basis of which they work!

What to rely on: Art. 18 p. 1

1. If defects are discovered in a product, if they were not specified by the seller, the consumer has the right, at his own discretion, to:

demand replacement with a product of the same brand (same model and (or) article);

demand replacement with the same product of another brand (model, article) with a corresponding recalculation of the purchase price;

demand a proportionate reduction in the purchase price;

demand immediate free elimination of defects in the goods or reimbursement of costs for their correction by the consumer or a third party;

refuse to fulfill the purchase and sale agreement and demand a refund of the amount paid for the goods. At the request of the seller and at his expense, the consumer must return the defective product.

In this case, the consumer also has the right to demand full compensation for losses caused to him as a result of the sale of the goods poor quality. Losses are compensated within the time limits established by this Law to satisfy the relevant consumer requirements.

In relation to a technically complex product, if defects are discovered in it, the consumer has the right to refuse to fulfill the purchase and sale agreement and demand a refund of the amount paid for such a product or make a demand for its replacement with a product of the same brand (model, article) or with a different product. brand (model, article) with a corresponding recalculation of the purchase price within fifteen days from the date of transfer of such goods to the consumer.

I wish you good luck and good, working equipment!!!

Thank you all very much for reading my review - a guide to action. I sincerely hope that you will not need this review as an applied element to action, but if suddenly a similar story happens to you, then this review will be useful to you!
